Product Classification

Is “Enhanced Absorption” an Advertising Issue or a Product-classification Issue?

Regulatory boundaries for enhanced-absorption claims used by beauty-delivery devices.

The Claim Reflects the Product Mechanism

“Enhanced absorption” may involve microcurrent, ultrasound, electroporation, pneumatic pressure, vibration or heat. These mechanisms affect the skin barrier and material transfer differently, so the question cannot be assessed only as advertising wording.

Questions That Must Be Answered

  • Does the device alter skin integrity or barrier function?
  • At what level does the liquid remain, and does it enter subcutaneous tissue?
  • Is the product used with ordinary cosmetics, dedicated consumables or medicines?
  • How are test endpoints designed, and do they match the intended purpose?
