What Should a Company Do When a Beauty Device Is Reported as an Unregistered Medical Device?

Do not begin by deleting every page or creating a new manual. Preserve the real device, software, parameters, marketing and sales evidence, then identify the affected product version and legal issue.

When a beauty device is challenged by a consumer, competitor, platform or authority as an unregistered medical device, companies often react by deleting pages, renaming the product or producing new documents. Rapid changes without preserving facts can create even more contradictions.

1. Preserve evidence immediately

  • Actual main unit, handpieces, software and packaging.
  • Production batches, purchase and shipment records.
  • Historical instructions, labels and test reports.
  • Website, e-commerce, video, livestream and training pages.
  • Distributor materials and communications.
  • The complaint, platform notice or official document.
  • Existing classification, registration or other results.

2. Identify the product version

Verify model, production date, output, software version and channel. The assessed sample and market product must be compared. A low-output result for another model cannot answer a complaint about a stronger device.

3. Separate the issues

The matter may concern medical-device status, misleading advertising, inconsistent instructions, safety, authorization or distributor conduct. Each issue requires different evidence. One classification document cannot resolve every problem.

4. Control further exposure

Pause new high-risk claims and inconsistent training, instruct distributors to preserve materials and stop unauthorized rewriting, and document any temporary suspension or correction.

5. Prepare a written facts report

  1. Product and version timeline.
  2. Real mechanism and output.
  3. Differences among filing, production and marketing.
  4. Evidence available and missing.
  5. Risk assessment and remediation.
  6. Point-by-point response to the notice.

6. Build ongoing records

Archive versions, screenshots, training, approvals and corrective actions by date. Quarterly checks of SKUs, software and major sales channels help demonstrate what the company knew and what it did.
